Legislation as a main source of English law entails the formulation of laws by the parliament, commonly known as the primary legislation. In this case, Bills are developed and debated upon in the house of commons. While they are approved, they are passed on to the house of Lords for approval and later to the Queen for royal assent, after which they become fully fledged laws of the UK (Hughes, 2002 p18). There is secondary legislation that entails the formulation of laws by other bodies, mandated by the parliament to make such laws. This includes bodies such as government ministries and the local authorities (Dicey, 1993 p51). Legislations by parliament do vary, based on the geographical locations, companies, or persons. The ordinary laws that applies universally to all people in all regions are called the public general acts. There is however a change in the traditional ways of legislation, w ith some modern legislations being undertaken by the government ministries, even without being approved first by the parliament (Barnett, 2008 p17). This is a form of delegated or secondary legislations, which has some reasoning behind. ... igned for specialized areas with unique professional needs that the parliamentarians cannot meet, the opportunity is provided for, under delegated legislation, where the expert opinions and skills are crafted and incorporate into laws (Barnett, 2008 p23). Further, delegated legislation allows for flexibility in law making, in that it becomes possible to address emergent issues that need legal backing through such statutory instruments or orders provided by the ministries for enactment. This serves to ensure that the law making process can adopted to urgent need of a situation, which would otherwise not be possible if the issue had to go through the normal parliamentary legislation (Hughes, 2002 p32). Thus, legislation as a source of law entails the rigid and the flexible avenues. This serves to ensure that the nature of both complex and simple issues are accorded the right avenues, with complex legislations being handled by the parliament and the simple flexible legislations being un dertaken by such delegated bodies as the ministries. The legislations done by the local authorities are called by-laws. The doctrine of parliamentary sovereignty provides for the amendment of common laws by acts of parliament, while the laws formed through parliamentary legislation cannot be changed by the statutes of common laws (Slapper, 2001 p133). Case law is another source of English laws. This refers to the reference made to judicial decisions that were made in the past, considering the ruling that was given by the then judges, in the case a legal suit of the similar nature arises in present day (Hughes, 2002 p55). Chapter 7 Reaction Paper - Essay Example Stereotypes end up dehumanizing a whole group of people, essentially pigeonholing them without giving them any chance to prove their own unique identity. When talking about the â€Å"accuracy† of stereotypes, I did not like the fact that the author mentions that some stereotypes are â€Å"accurate.† The fact that he goes on to mention very objective terms (like the income of a certain group of people), further augments my point. Stereotypes, I feel are based on subjective terms and not objective ones, and that is precisely why they are so damaging. However, I did like the idea the author then goes on to say how, even though we cannot get rid of stereotyping all together, we need to recognize them for what they are so that they can be productive and not destructive. In this regard the chapter itself contains certain stereotypes, which the author also admits. However, I would have liked it if there had been mention of stereotypes causing prejudices to be formed. I liked h ow the article relays the idea that we need to acknowledge that people are different, or that certain groups of people will be different as a collective. However, if that is true, then, perhaps, there is a premise for stereotyping to be an effective social tool. Nonetheless, it need not be so if we refrain from making rigid assumptions about a whole group of people and applying them on individuals as well.

In a vignette called hips she discovers she starts growing hips. Then she with her sister and friend start telling each other why women grow hips. This shows that Esperanza is starting to become a woman. This is because she is starting to grow hips and that is an important change and sign that a girl is indeed growing up. In addition, she is now aware that she is becoming a woman and is starting to develop. This shows that because she starts telling his two sisters and her friend about her growing hips. This is because she is interested and exited about the fact that she now starts to have hips. Furthermore, they start to discuss and argue about why women have hips. This shows that they as girls are growing up, but the things they argue about still show that they are not so mature but start maturing. This is because they still have childish beliefs about why they grow hips. Hips tells us how Esperanza is growing up and they start the maturing process. Esperanza as we know is a sort of poor person and she has no money to buy too many things. There is a vignette called chanclas were she starts to feel ashamed of her shoes that were old and ruined. This shows that she is starting to be aware of how she looks and if she looks fine or bad. This is because as she starts to mature and grow up she starts to develop more vanity. In addition, she starts to notice that boys are looking at her and that makes her try to be as beautiful as she can possibly be. This shows that as she matures, and as she starts to notice boys and vice versa she feels the urge of being attractive to them and to grab their attention. This is because she knows that to get married or to attract boys she has to be  beautiful enough for the boys. Furthermore, as the vignette develops it says that she in the urge of trying to look good, and starts to hide her shoes under her dress. This shows that she is aware that people are looking at her and makes her feel uneasy about her shoes. This is because she sees a boy looking at her from the other side and it sets her shame wild trying to hide the shoes. This vignette shows us how she starts to feel ashamed of her things and how much she cares about her appearance. The House of Mango Street is a story written in vignettes, which shows how a girl grows up and how she is maturing. The story shows us how Esperanza, the protagonist, changes from a girl to a woman. For me the story was a little confusing because of me being a boy and the story about a girl. For the conclusion the story was a coming of age story that tells us the side that we dont know about people like Esperanza and how they grow up.

Movement Of Small Intestine Biology Essay In much of the gastrointestinal tract, smooth muscles contract in sequence to produce a peristaltic wave which forces a ball of food called a bolus while in the esophagus and gastrointestinal tract and chyme in the stomach along the gastrointestinal tract. Peristaltic movement is initiated by circular smooth muscles contracting behind the chewed material to prevent it from moving back into the mouth, followed by a contraction of longitudinal smooth muscles which pushes the digested food forward. Catastalsis is a related intestinal muscle process.(Google) Movement of small intestine The small intestine is responsible for removing nutrients from food and bringing water and electrolytes in the body. It also moves food through a specific part of the digestive tract, into the large intestine Once processed and digested by the stomach, the milky chyme is squeezed through the pyloric sphincter into the small intestine. Once past the stomach a typical peristaltic wave will only last for a few seconds, travelling at only a few centimeters per second. Its primary purpose is to mix the chyme in the intestine rather than to move it forward in the intestine. Through this process of mixing and continued digestion and absorption of nutrients, the chyme gradually works its way through the small intestine to the large intestine. During vomiting the propulsion of food up the esophagus and out the mouth comes from contraction of the abdominal muscles; peristalsis does not reverse in the esophagus. Types of contraction.(Guyton pg# 786) There are two main types of contractions that occur in the small intestine as well as other parts of the gastrointestinal tract. These movements are known as mixing contractions or segmentation contractions and propulsive contractions. While these contractions are categorized separately, both perform similar functions. Mixing movements mainly churns food but also propels it. Propulsive movements primarily push food towards the anus but also spreads it out for allowing the digestive enzymes to mix with it. Mixing or Segmentations contraction When a portion of small intestine becomes distended with chyme,stretching of the intestinal wall elicits localized cocentric contractions spaced at intervals along the intestine and lasting a fraction of minute.The contraction cause segmentation of the small intestine.They divide the intestine in to spaced segments that have the appearance of a chain.As one set of contraction relaxes a new set often begins,but the contraction this time occur mainly at new points between the previous contractions.Therefore the segmentation contraction chop the chyme two to three times per minute. The segmentation contractions become exceedingly weak when the excitatory activity of the enteric nervous system is blocked by the drug atropine. (Guyton pg # 786) While mixing contractions also propels food through the small intestine, its main function is to churn the chyme with intestinal enzymes and mechanically break down some particles.(Google) Propulsive Movements or contraction Chyme is propelled through the small intestine by peristaltic waves.These can occur in any part of small intestine ,and they move towards the anus at a velocity of 0.5 to 2.0 cm/sec,faster in the proximal intestine and slower in the terminal intestine.They normally are very weak and die out after traveling only 3 to 5 cm.This means that 3 to 5 hours are required for passage of chyme from the pylorus to the ileolic valve.(Guyton pg #787) These contractions are concentric meaning that they run around the intestine as illustrated in the diagram below. These spaced segments relax and constrict a number of times thereby à ¢Ãƒ ¢Ã¢â‚¬Å¡Ã‚ ¬Ãƒâ€¦Ã¢â‚¬Å"choppingà ¢Ãƒ ¢Ã¢â‚¬Å¡Ã‚ ¬Ã‚  the chyme and mixing it back and forth with enzymes, mucus, water and ions in the intestine. These contractions occur about 10 to 12 times per minute in the duodenum (first part) and jejunum (mid) of the small intestine and diminish to about 8 or 9 contractions per minute in the terminal ileum (end portion).(Google) Control of Movement through the Small Intestine A number of hormonal and nervous factors initiate and maintain peristalsis and mixing. Nerve impulses which travel throughout the small intestine are triggered by the gastroenteric reflex (refer to Defecation Reflex) and localized distention of the duodenum. These impulses are propagated via the enteric nervous system, mainly the myenteric plexus, which is the gutà ¢Ãƒ ¢Ã¢â‚¬Å¡Ã‚ ¬Ãƒ ¢Ã¢â‚¬Å¾Ã‚ ¢s own internal network of nerves. It is further regulated by impulses from the central nervous system via the vagus nerve and sympathetic trunk.. The   digestive hormones, cholecystokinin (CCK), gastrin and motilin increase intestinal motility while secretin decreases the activity. In addition, serotonin and insulin can increase motility while glucagon can decrease motility.(Google) Ileocecal Valve The ileocecal valve controls the entry of chyme into the colon and prevents backflow of fecal matter into the ileum of the small intestine.A principal function of the ileolic valve is to prevent backflow of fecal contents from the colon in to the small intestine. It has valve lips that closes when the pressure in the cecum builds up. In addition, the end portion of the ileum, just proximal to the ileocecal valve, has a muscular sphincter called the ileolic sphincter. This is constantly constricted and restricts the flow of chyme from ileum into the cecum unless appropriately stimulated to relax and thereby open. The ileocecal sphincter ensures that intestinal contents stay within the small intestine long enough for sufficient absorption of nutrients.(Guyton pg # 788) Motility disorders in small intestine Problems in the small intestine occur when food is blocked, unable to move, or contains bacteria that cannot be broken down by small intestine cells. Intestinal Dysmotility is a dysfunction that hampers peristalsis, or the contractions that move food forward. When food cannot move forward, cramps and headaches occur in the patient because the digestive process has been stopped unnaturally. Bacterial Overgrowth is a condition that leads to immediate expulsion in the small intestine. If there is an overload of bacteria, the small intestine cannot handle it, and stomach pains and vomiting occur. Cancer can strike the small intestine, although it usually is detected in other parts of the body first. Worms and parasites can occasionally affect small intestine health, although these can most often be removed by careful surgeons or specialized medicines.(Google) Movement in large intestine Movement of food through the large intestine is caused by smooth muscle contraction called peristalsis the best way to describe this is to imagine how a snake moves its abdominal muscles to move. As opposed to the more continuous peristalsis of the small intestines, faecal contents are propelled into the large intestine by periodic mass movements. These mass movements occur one to three times per day in the large intestines and colon, and help propel the contents from the large intestine through the colon to the rectum.(Google) Principal functions of colon are It absorbs water from indigestible food matter and then passes useless waste material from the body. In the colon, the major process that takes place is the reabsorption of water.(Guyton pg # 788) Types of movements or contractions The movements still have characteristics similar to those of small intestine can be divided into mixing movements or Haustrations and propulsive movements or Mass movements. Mixing movement In the same manner the segmentation movements occur in the small intestine large circular contractions occur in the large intestine,about 2.5 cm of circular muscle contracts.At the same time longitudinal muscles contracts.These combined contractions cause the unstimulated portion of the large intestine to bulge outward in to bag like sacs called haustrations. Mass movements Much of the propulsions in the cecum and ascending colon results from the slow but persistent haustral contractions requiring as many as 8 to 15 hours to move the chyme from the ileolic valve through the colon while the chyme itself becomes fecal in quality a semisolid slush instead of semifluid.A seriesof mass movements usually persists for 10 to 30 minutes .then they cease but reurn perhaps a half day later.When they have forced mass of feces into the rectum the desire for defecation is felt.(Guyton pg #789) Another very important type of motility that occurs in the large intestine is the high amplitude propagating contraction (HAPC). These contractions only occur 6-8 times per day in healthy people, but they are extremely strong contractions, which begin in the first part of the large intestine and sweep around all the way to the rectum; they stop just above the rectum.(Google) Motility Disorders of the Large Intestine Constipation Constipation is usually described as infrequent bowel movements (less than 3 per week), passage of hard stools, and sometimes difficulty in passing stools. The sensations associated with constipation can include a constant feeling of needing to go, or a sensation of bloating or fullness. In children, constipation often leads to fecal incontinence. Diarrhea The symptoms of diarrhea are frequent, loose or watery stools, and a subjective sense of urgency. Patients with diarrhea also may worry about loss of control over bowel movements. An excessive number of high amplitude propagating contractions can be a cause of diarrhea Hirschsprungs disease Hirschspurngs disease is a rare congenital (a person is born with it) disorder that is caused by absence of nerve cells (ganglion) in the rectum and/or colon. Usually the problem involves only the bottom portion of the colon, but in some it involves the entire colon or even part of the small intestine. The part of the bowel that lacks nerve cells (aganglionic) cannot propel stool toward the anus, and therefore results in obstruction, severe constipation, or inflammation (enterocolitis). Although symptoms usually begin within a few days after birth, some people dont develop them until childhood or even adulthood. Irritable bowel syndrome (IBS) The term irritable bowel syndrome, or IBS, is used to describe a group of symptoms that occur together. Policy Identification and Explanation Every year, students are required to participate in standardized testing. Why would each student be forced to take such tests every year? This is because of the No Child Left Behind Act of 2001(NCLB). In the NCLB Act of 2001 Public Law 107-110 115 Stat. 1445-6, it states that, â€Å"each state plan shall demonstrate that the state has adopted challenging academic content standards and challenging student academic achievement standards that will be used by the state, its local educational agencies, and its schools to carry of this part† (The NCLB LAW). The NCLB Act of 2001 Public Law 107-110 115 Stat. 1445-6 is based on the development of state content and academic achievement standards which are measured by state assessments and compared to the â€Å"adequate yearly progress† expectations. Each state is allowed to develop their own standards. History/Background Standardized tests date back as far as 2200BC, when the Chinese government administered written exams to candidates interested in being in the Civil Services (Young, 2005). The exams were mostly memorization of established wisdom. By 1803, exams were widespread throughout Europe as a way to get into a respected college. Standardized tests didn’t appear in the United States until the mid 19th century. Written exams were introduced in Boston in 1845 for government funded schools and in 1851, Harvard started the first entrance exams. From 1900-1915, psychology was a big influence on the tests that were administered. During this time, Lewis Terman helped expand Alfred Binet’s ideas about an intelligence test. This later, in 1916 became known as the IQ test. In 1926, colleges began using the SAT, a multiple-choice exam. This was a great advancement in the form of standardized tests. The SAT made grading easier and the testing more consistent. The SAT replaced any written test for college entry. For the next 19 years, the number of IQ tests increased substantially (Young, 2005). During these 19 years, different tests are created from the inkblot tests to the scholastic multiple choice test. At the start of the 1960’s, a book was published called, The Tyranny of Testing (Young, 2005). This book started the criticism due to the issue of standardized testing. The strongest criticism was standardized testing wasn’t helping students to achieve and reach their full potential. This statement was backed by the Russians launching of Sputnik in 1957. American’s began to wonder why the Russians had beaten us into space.

Applying Theory to Practice Essay

Theory offers procedure and arrangement to nursing knowledge and provides a methodical way of collecting data to define, clarify, and forecast nursing practice (McEwen & Willis, 2011). Nurses use nursing theory to develop a certain outlook about patient care. Nursing theories serve as a shared groundwork for nursing practice across all settings to develop better patient care outcomes. This paper will explore childhood obesity and then apply to practice a mid-range and a borrowed nursing theory to the practice problem. Childhood obesity is a national problem that crosses all economic and social lines. Overweight children and adolescents are in jeopardy of having heart disease, such as hyperlipidemia or hypertension. In a varied group trial of 5- to 17-year-olds youths, 70% of overweight youth had at least one risk factor for heart disease (Freedman, Zuguo, Srinivasan, Berenson, & Dietz, 2007). Overweight youth are at higher risk to develop Type II diabetes (Li, Ford, Zhao, & Mokdad, 2009). Type II diabetes increases the risk of long term complications such as renal disease, visual impairment, cardiovascular disease, amputation, neuropathy, up to and including death. Youth that are overweight are also at higher risk for musculoskeletal issues, sleep disorders, socio-economic problems due to families inability to obtain medications and treatment. Overweight youth are also at risk of psychological problems such as being bullied in school, depression, suicide, and poor self-esteem (Dietz, 2004). Children and adolescents who are obese often carry this into adulthood and become obese adults. This sets them up for the likely hood of adult health problems such as heart disease, diabetes, stroke, and osteoarthritis (Guo & Chumlea, 1999). Some of the long term ramifications of childhood obesity include but are not limited to many types of cancer, including cancer of the breast, colon, endometrium, esophagus, kidney, pancreas, gall bladder, thyroid, ovary, cervix, and prostate, multiple myeloma and Hodgkin’s lymphoma (Kushi et al., 2006). There are so many short term and long term emotional and physical ramifications associated with childhood obesity that it warrants research and study. Childhood obesity is preventable and treatable. As a society it is time that measures were put into place to reduce the ever increasing numbers of children dealing with childhood obesity on a daily basis. There also seems to be a tendency for obesity to be passed down from generation to generation not because of genetics alone, but because of the learned lifestyle of the family. As mentioned in the case study Weimen wore a suit and with that sport shoes, so this kind of impression spoils the firm’s image resulting into losing potential clients.So very important it is to make a good Presentation Negotiation Skills – all the employees were technically very good and did ha ve the knowledge of what they had to with their product and they were the best in their jobs, but one thing that they lacked as the sales people was on their negotiation front, they rarely know how to negotiate a price or even try to put a price according to the orders, so it was important to learn how to negotiate with the client, because a good negotiator can always get a good business to the firm.Decision Making – Another important skill that the employees need to render to is that of decision making, it is very important for any employee to learn how to be decisive about the deal, as we know the quicker the decision the quicker it is for the deal to go through and as there is more delay in the decisions, there are higher chances of the client to move away. So it is important to know the decision making process.Quoting Tenders – As we know that in the textile industry there was an important element of quoting tenders , so to develop the skills of quoting tenders , t he better the quoting then the competitors the better are the chances of getting the deal through. The above are few of the skills or the Core Competencies that the sales force team has to develop in order to capture the textile industry.The sales team of World Wide Equipment is not one of the easiest to join, the recruitment procedure of the company has been a very rigorous one and it s task to get into the job, the sales team of the company has to cover a lot of ground and do a lot of various things in order to continue the selling.Overall the sales force has been an effective and an efficient one for the company, before entering the textile industry the employees have been efficient with their work, getting continues sales effectively putting them in a consistent second position, but however they were not the most effective sales team as compared to the three offices as, Shanghai as been in top all the years , though one added advantage that it had was of being the first office i n Mainland China, but if we notice the sales , year on year Beijing has tried to come close to Shanghai , that means that year on year the performance of the sales team in Beijing has been very consistent, but something more needs to be added in order to beat the leading sales team in Shanghai. So if we overall look at the performance of the sales team, we an say that they are not the most effective out of the three, but they are on their way on becoming the most effective team, a few alterations in their approach or a little amount of prior learning about their future ventures could account for a considerable change in their future performances. Frank Wang was a regional sales manager; joined World Wide Equipment in the year 1995, Wang had been a very impressive sales person and has been a very fast growing employee for the company, after 18 months he was promoted to the senior sales manager and in further 16 months he was promoted to the post of regional sales manager making which made him the first Chinese national to hold a managerial position. Wang was accountable for 1) Creating the region’s sales forecast and budget fulfilling that budget 2) Sales engineer recruiting ,training and organizational development 3) Sales performance evaluation and coaching ) Daily sales /sales leads management and job assignment 5) Contract negotiation and management of contract execution Looking at the responsibilities of Wang, it can be said that he did have a lot of task and had to cater to all the different departments in the organization in order to keep the firm fit and fine. Commenting if Wang has been a good sales manager , what we can see in the case study is that he has both pros and cons in his approach to run the Beijing sales team. Wang had created a very effective sales team under him, educating his sales team how to go about their business, It was under his supervision that sales team of Beijing started inching closer to the shanghai sales team. He had helped create two of the promising employees under him Liu Hongyuan and Jiang Li. Wang had another impressive characteristic of being the person who saves the company’s money and he was successful in installing this behaviour in his other employees.When all the other offices would spend money lavishly and bill it on to the company where as Beijing office was a complete contrast of the situation, they would look out for the minimum way possible this feature was instilled by Wang into his employees. Wang what it seemed was a very honest person when it came to recruiting, he would recruit the best out of the lot, his eye for the talent has always been an accurate one. Wang somehow felt that owed his success to Yu that is what made him go against his policy of not recruiting people on the basis of recommendation, but he had to take Weimen in the firm. This somehow showed that he could not stick to his hiring policy and even after repeated failure from Weimen; he could not report his senior to take him off the Beijing office, so yes Wang did have some cons.Overall Wang was a valuable asset to the firm and he was some or the other way a good regional sales manager and he did create some good business for the firm, one bad half yearly result does not prove that he was bad manager, he had the rest of the other years of sales to prove that he has been a success in the Beijing office and had cultivated a great sales team a good environment for them and has made them perform consistently. If put under such circumstances what I would have done is that, taken a few measures in order to shake things a little bit and take it uphill from the recent downfall it has gone through, I would have to make some stern decisions in order to put things back to action. Weimen Situation – Instating Weimen had caused somewhat of a headache to the World Wide Equipment Beijing branch and some or the decision had to be made.If the onus was on me I would go for Weimen’s ba ckground check and with the contacts and influence that his uncle was a very resourceful individual in the city of Guangzhou, so loosing Weimen would mean that losing good business in the city that has always been number three in the list and would be over all bad for the business, so what I would do is shift Weimen to Guangzhou, a city where he would have some influence in the market causing and could bring in a lot of business to the firm and eventually making an overall profit, though still a little bit of training would be required too and a little bit counselling on how to go about the whole situation, but losing him would actually mean that losing somewhat of a potential chance of losing out a chance of enhancing the business in laggard place in like Guangzhou. Textile Industry Entry – The next issue would be of entering the upcoming textile industry and entering the industry in a convincing manner, so what I would do is train the staff in the textile industry or even r ecruits a few people who would have expertise. The chunk of the textile industry is quite big to let go off.Look Into Sales – As the sales have been dipping down, I was a regional sales manager I would actually get into the sales myself and handle the big clients myself and by the senior sales managers who are the cream of the company, because it is the 80 – 20 in every business, which means that 80% of the business comes from the 20% of your clients. Boosting Morale of the Employees – If the onus would be on me I would try and increase the morale of the sales team, because that is a very integral element, without a good morale or state of mind it would not be possible to conduct sales in the best possible manner. In a company it’s always the sales team which brings in the money and it is important to have them maintain a healthy morale.
